Effect of These Terms and Conditions
Please review these Terms and Conditions. Your use of this website constitutes your agreement to follow these rules and to be bound by them. If you do not agree with any of these Terms and Conditions, then do not use or place any orders from Diecasm’s website.

Shipping
All orders shipped via FedEx or USPS in accordance with our shipping provider’s policies and procedures. You may contact our shipping provider to request a shipping schedule. Except for shipments to a designated US PO Box, Diecasm may choose how the order is shipped at no additional expense to the Customer. Alternatively and only with pre-approval from Diecasm, you may pick-up your item from Diecasm at a designated location.

All US shipments are sent with signature required - Diecasm will decide when to apply or waive this depending on the item(s) being shipped. If you wish to waive this requirement Diecasm must be notified in writing before the shipment is sent and you accept all risks including damage to or lost for the shipment.

Shipping Free
All orders received on November 1st, 2021or thereafter will no longer ship free. Orders placed before November 1st 2021 that qualified for free shipping and have not yet shipped will still receive free shipping. Diecasm may choose to run free shipping promotions in the future and such promotions will require a coupon code that must be entered at the time the order is placed to be valid.

Shipping International
International shipping only includes the transportation of the products from Diecasm's office or Diecasm's designated warehouse to you at an international location. International shipping does not include VAT, GST or any other customs fees, duties and taxes which are not the responsibility of Diecasm and are 100% your responsibility.

Product Availability
Each item listed herein will indicate if it is In Stock, Available to Order, Available to PreOrder, on order, special order, custom order, or PreOrder (pre-order). Diecasm may inform you of any backorder items which may include In Stock and PreOrder (pre-ordered) items with your order confirmation.

PreOrdered Items
When you PreOrder an item, your credit card or PayPal account shall be immediately charged when the order is executed by Diecasm. All PreOrder items will appear as back-ordered items on your invoice. When the item is received by Diecasm, PreOrder/back-order items shall be shipped to you by Diecasm. If you do not wish to be immediately charged for a Pre-Order item, opt for the Diecasm Payment Plan, Payment by Check, or, create a Wish List instead.

Diecasm has no control on when the PreOrdered item will be made available by the manufacturer and/or the manufacturer's distribution channels ("Manufacturer's Channels") including but not limited to the manufacturer's distributor, the manufacturer's wholesaler, and/or the manufacturer's factory sales agent. This means if an availability date for the item is quoted by Manufacturer's Channels and/or by Diecasm, this date is an estimated availability date only. A PreOrder may not be cancelled because the PreOrdered item did not arrive by the availability date; and, if you dispute a PreOrdered item with your credit card company or PayPal account, Diecasm reserves the right to flag your account to not accept future PreOrders.

In the event Diecasm receives written notification from the manufacturer directly or via the manufacturer's authorized channel provider that an item will not be produced or will be produced different than originally described, Diecasm will notify you and ask if you prefer to continue to receive the modified item, a store credit for the item or a refund.

International Orders
International orders are subject to a waiting period of up to 30 days prior to shipping which may be waived at the sole discretion of Diecasm. When an international order is received, Diecasm will pull from inventory and set aside In Stock items until the order is released for shipping. This is the result of attempted fraudulent credit card transactions with the waiting period designed to vet out proper from improper credit card orders. If an international order is contested, the pulled items will be returned to inventory; and, if after the contested transaction proves to have been incorrectly contested, Diecasm bears no responsibility if one or more of the items on the order are no longer available, except to refund the value of the item(s) no longer available.

Diecasm Payment Plan
Merchandise eligible for the Diecasm Payment Plan is shown under the "Diecasm Payment Plan". Order eligibility is at the sole discretion of Diecasm, and, if a Customer's Diecasm Payment Plan order is not accepted by Diecasm, the Customer may either remit payment in full for the order, cancel their Diecasm Payment Plan order, or have Diecasm cancel their Diecasm Payment Plan Order. The mechanics for choosing the Diecasm Payment Plan are available on each eligible merchandise's listing.

Return Policy
All returns are subject to Diecasm’s return policy as set forth below:
(a) If for any reason you are not completely satisfied with your purchase, you may, within ten (10) days of your purchase date, return the item for exchange, minus shipping and handling charges, excepts as follows: (i) If the reason for your return is because the item is defective in any manner through no fault of you, then Diecasm will promptly send you a replacement item, or if one cannot be provided, you will be provided with either a Diecasm credit, Diecasm coupon or a full refund. (ii) If the reason for your return is because you do not like the item or the item did not meet your expectations for whatever reason, you will be provided with a Diecasm coupon code good for the value of your purchase, minus shipping and handling charges which shall be sent via email after the item has been received and inspected by Diecasm. (iii) Close-out, Sale, On Sale, Last Chance, Factory Flawed, Factory Flawed Edition, Barn Find Edition, Raffle, Regalia, Special Order and Custom Order made items may not be returned for any reason unless it is proven that the items were defective prior to shipment by Diecasm (or the Originator for Factory Flawed items) and your receipt of same. (iv) PreOrder and Back-Order items may not be returned for any reason, however, if requested in writing via email to Diecasm, Diecasm may permit you to order an item of equivalent value at Diecasm's option. (v) Special Order Handling and Special Order One of One Collection items may not be returned for any reason.
(b) In order to return an item, please contact [email protected] to explain the reason for your return. Wherever appropriate, you will be provided with a Return Authorization Number to be included with the returned item(s) on the inside and outside of the return box.
(c) All return merchandise must be received by Diecasm unused and in its original packaging. Do not alter the original packaging in any manner. Please place the original packaging inside a separate container for shipping back to the address stated below. Any items that are not received in their original, unsealed packaging will not be accepted by Diecasm and you will not receive a replacement or refund, although Diecasm, at its sole and absolute discretion, may offer a credit or Diecasm coupon in an amount determined by Diecasm toward a future Diecasm purchase.
(d) All Diecasm Payment Plan merchandise received by Diecasm is only refunded for the value of the Diecasm Payment Plan merchandise and not for shipping or any other merchandise on the same order.
(e) Diecasm is not responsible for defects or damages caused to merchandise due to your mishandling, misuse or abuse of the merchandise.

Charitable Contribution
Diecasm will donate ten percent (10%) of net sales revenues collected by Diecasm, excluding shipping, handling, applicable sales taxes, Automodello, NonProfit Products, and, On Sale to certain charitable organizations as provided below.

You may designate which charitable organization will receive the ten percent (10%) contribution made as a result of your purchase by choosing from the list of organizations provided to you when you order. If you do not select an organization to receive the contribution from the list provided, Diecasm will choose the organization that will receive the contribution made as result of your purchase. Diecasm will not accept any returns or provide any refunds in the event you are dissatisfied with the charitable organization selected to receive a contribution from Diecasm.

You acknowledge and agree that the charitable organization which receives a contribution as a result of your purchase will have the unrestricted right to use your name and to publicize the contribution.

Charitable Contribution | Automodello
Diecasm may donate more than ten percent (10%) of net sales revenues collected by Diecasm for Automodello products per Diecasm's agreement with each nonprofit organization. Except for this increased donation for Automodello products, all other applicable Charitable Contribution terms shown shall apply. If a Coupon Code is used in the purchase of Automodello products, the donation is reduced to zero percent (0%) of net sales revenues collected by Diecasm for Automodello products. If an Automodello product(s) is on-sale, the applicable donation for those Automodello product(s) is reduced to zero (0%) percent.

Charitable Contribution | NonProfit Products
Diecasm encourages additional donations to your selected or to multiple nonprofits. When you select Add to Cart for nonprofits whose product value is greater than zero dollars ($0.00), Diecasm will contribute the value of your additional donation to the selected nonprofit(s). Such donation shall not be taxed by Diecasm during Check-Out and 100% of the donation value shall be forwarded to the nonprofit(s). Except for this additional donation for NonProfit Products, all other applicable Charitable Contribution terms shown shall apply.

Charitable Contribution | On Sale
Diecasm will not donate ten percent (10%) of net sales revenues collected by Diecasm for On Sale, Close-Out,or Sale (collectively known as "On Sale") items. When a purchase includes both On Sale and non-On Sale products, Diecasm shall only make a Charitable Contribution on the non-On Sale product(s) per the Charitable Contribution terms shown shall apply.

Charitable Contribution | Raffles | Drawings
Raffle, drawings or similar product (collectively known as Raffles) purchased provides direct benefit to their respective organization(s). Diecasm will not donate ten percent (10%) of net sales revenues collected by Diecasm for Raffles. When a purchase includes both Raffle and non-Raffle products, Diecasm shall only make a Charitable Contribution on the non-Raffle product(s) per the Charitable Contribution terms shown shall apply.

Diecasm Exhibit Pricing
Diecasm may exhibit at events where pricing may differ from the Diecasm prices listed on this website. If the price differs, the price on the item at the time the order was made will take precedent for the item picked-up by the purchaser. For a PreOrdered item, the price listed on the Diecasm website will take precedent.

Marks, Registered Marks and Copyrights
Diecasm, Bridging the Gap Between Collectors and NonProfits, Bringing Collectors and NonProfits Together, One of One Collection, Automodello, Dreams Engaged, ONE12, ONE24, ONE32, ONE43 and Resin Art are marks or registered marks of Diecasm, LLC. Moments in Motorsports is a joint mark of Automodello and History in Miniature. Shrinkode is a mark of Aqubanc, LLC and used with permission. All other marks, registered marks, and copyrights appearing on this website are the marks, registered marks and copyrights of their respective holders with all rights reserved by each respective holder.

Special Information for NonProfit Organizations
In order for a nonprofit organization to be listed on this website and receive contributions, the nonprofit organization must, in turn, have a link on its website to Diecasm’s homepage, unless waived by Diecasm, in its sole and absolute discretion, for a specified period of time. All nonprofit organizations listed on Diecasm’s website hereby agree to include Diecasm’s name and a link to Diecasm’s homepage on their website, and further agree not to list any of Diecasm’s competitors on their website during the period that they are participating in this program. If a nonprofit organization participating in this program fails to meet the foregoing requirements, Diecasm reserves the right to remove such nonprofit organization from its website and such nonprofit organization will no longer be eligible to receive any contributions from Diecasm.

All nonprofit organizations listed on this website represent and warrant, and by allowing their name and website to be included on Diecasm’s website, agree to the following: (a) that such nonprofit organization qualifies for tax-exempt status under Section 501(c)(3) of the Internal Revenue Code; (b) that such nonprofit organization can provide evidence of its qualification under Section 501(c)(3) of the Internal Revenue Code; and (c) that such nonprofit organization will immediately inform Diecasm if its status as a 501(c)(3) organization is revoked or suspended for any reason.

Nonprofit organizations operating under Sections 501(c)(6), 501(c)(7) or 501(c)(10) of the Internal Revenue Code may be listed on this website and warrant, and by allowing their name and website to be included on Diecasm’s website, agree to the following: (a) that such nonprofit organization qualifies for tax-exempt status under their respective Section 501(c) of the Internal Revenue Code; (b) that such nonprofit organization can provide evidence of its qualification under their respective Section 501(c) of the Internal Revenue Code; and (c) that such nonprofit organization will immediately inform Diecasm if its status as a Section 501(c)(6), 501(c)(7) and 501(c)(10) organization is revoked or suspended for any reason.

A nonprofit organization that receives a charitable contribution from Diecasm may use the name of Diecasm or its customer to publicize the contribution made as a result of the purchase made by Diecasm’s customer. Diecasm reserves the right to request any additional information it deems necessary or advisable to determine whether the nonprofit organization will be listed on its website.

Special Information for NonProfit Organizations | NonProfit Products
The nonprofit organization is required to deliver their logo to Diecasm to order to participate. After Diecasm receives the logo, Diecasm shall increase the NonProfit Product value above zero dollars ($0.00). Diecasm shall assign an initial NonProfit Product value which the nonprofit organization may change by sending an email to [email protected]. The NonProfit Product value enables the nonprofit organization to receive additional donations from the purchaser which shall not be taxed by Diecasm during Check-Out and 100% of the donation value shall be forwarded to the nonprofit organization. Except for this addition donation for NonProfit Products, all other applicable Charitable Contribution terms shown above shall apply.
